Appeals

Decisions of the Registered Organisations Commissioner under the Fair Work (Registered Organisations) Act 2009 are able to be appealed by an aggrieved party under section 604 of the Fair Work Act 2009.

Applications for appeal must be lodged with the Fair Work Commission within a short period of time after the decision being made. For more information on how to appeal the decisions of the Commissioner and how long you have to lodge an appeal please contact the Fair Work Commission external-icon.png.

The Registered Organisations Commission does not hear appeals.

Some decisions of the Commissioner are not able to be appealed under section 604. These include:

  • Orders relating to alternate disclosure arrangements for officers and organisations;
  • The Commissioner’s Reporting Guidelines for financial reporting.
